Under the proposed framework, individuals seeking to transfer cryptocurrency offshore must route transactions through authorized domestic providers, with the transfers subsequently reported to the Reserve Bank’s Financial Surveillance Department. Domestic purchases and sales of cryptocurrency in rand currency through local providers would not require reporting. Currently, only individuals would be permitted to move crypto assets internationally, and only within allowances established for foreign currency transactions.
The guidelines are intended to prevent cryptocurrency from circumventing South Africa’s existing financial controls while assisting authorities in identifying and addressing illicit financial flows. The rules define cross-border transactions as those moving from a local authorized Crypto Asset Service Provider to an offshore provider or into a private, non-custodial wallet. The SARB indicated that the framework does not confer legal tender status on cryptocurrency and does not yet classify different categories of digital assets, with continued research planned.
