Members of Congress and the public have criticized the justices’ approach to these requests. However, Justice Elena Kagan told Congress in July that the court was improving its practices by providing greater justification for decisions.
Jackson acknowledged these improvements while cautioning that they remain insufficient. She stated that although the court “began to explain more,” it still does not provide the comprehensive explanations given to cases reviewed on the merits docket. “If we’re not careful, the emergency docket can and will become an end-run around the standard review process,” Jackson said. Her remarks came hours after the Trump administration filed another emergency request seeking permission to deport immigrants to countries other than their own.
