Novo Nordisk, the manufacturer of Ozempic and Wegovy, filed a lawsuit against Eli Lilly on Tuesday in the United States, alleging the company engaged in misleading advertising practices regarding weight-loss medications. The lawsuit claims Eli Lilly’s advertising campaigns created a false impression that its drugs, Mounjaro and Zepbound, outperform Novo’s products.
According to Novo’s complaint, Eli Lilly compared the highest approved doses of its medicines against lower doses of Novo Nordisk’s offerings while omitting newer, higher-dose options from consideration. The Danish company asserts these marketing tactics violated federal and state false advertising and unfair competition laws. Novo argued that Eli Lilly deliberately selected outdated studies and deceptively presented superiority claims while burying or omitting important clinical context needed for accurate comparison.
Novo Nordisk is seeking court action to compel Eli Lilly to discontinue the disputed advertisements and launch a corrective advertising campaign instead. The company indicated it would file a motion for a preliminary injunction to block the commercials if Eli Lilly does not voluntarily remove them from circulation.
Eli Lilly responded to the allegations by defending its advertising as truthful and transparent, grounded in what it characterized as the most direct scientific evidence available. A company spokesperson stated the firm stands behind its campaigns and committed to defending against the lawsuit vigorously. Eli Lilly characterized its comparison trial as robustly designed and meeting gold standard criteria.
The dispute reflects intensifying competition between the two pharmaceutical giants in the rapidly expanding weight-loss drug market, particularly in the United States, which industry analysts project could exceed $100 billion in value by 2030.
